Error 38 Apple TV

Tried to update and restore my apple tv unit, and when restoring an error appears with error number 38.

now the unit wont work nor update.

help.??!!

Apple TV, OS X Mountain Lion (10.8.5)

well 38 in not on the list but all the number lower and higher in that range are security software blocking itunes

worth looking into
