Menu bar background gets black -

I can't say when this happens or why this happens, it just happens and I've to restart my MacBook Pro to see the menu bar (I hope this is the name...) again.

I couldn't find anyone reporting this issue.

osx 10.8.5 (12F37) MacBook Pro Retina, 13-inch, Early 2013

I notice this happens whenever my laptop does not wake from hibernation correct. What I have had to do whenever this occurs is open up settings and change my resolution. In this case I change it from "more space" which is the max resolution to "Best" Retina resolution- which changes resolution and fixes the menu bar. Then switch it back to the way I normally keep it.


For my situation I need to find out why my laptop is not waking up from having the lid closed. But changing the reoslution back and forth definitely fixed my menu bar issue. (Its happend many times over the last month or two)
