The encryption effectively does not apply if the user has full access to the device home screen and interface. The device has no way of know who is using it, just that it is unlocked and someone is using it as it was designed to be used.
Really, the only security feature in iOS to safeguard your content is the lock code.
Its a bit like asking if you give the keys to your house to someone, are you safe from them snooping around once inside.
