How come my passcode isn't working?

So I recently updated to 7.0.2. Thing is, the passcode wont work. It worked perfectly fine before and now it keeps disabling, I tried all possiblities, still no access.

iPod touch, iOS 7.0.2

Forgotten Restrictions Passcode Help

You will need to restore your device as New to remove a Restrictions passcode. Go through the normal process to restore your device, but when you see the options to restore as New or from a backup, be sure to choose New.

I cant reset it or restore it because the icloud is on and the passcode isnt working.

What exactly happens when yo place the iPod in recovery mode and restore via iTunes?

Can you comunicate with the iPod via icloud.com?

Okay so I tried to communicate with my ipod via icloud.com but it said my icloud isnt even turned on or set up. This is frustrating. It cant go into recovery mode and cant be restored by itunes BECAUSE of icloud, every time i try to reset it on pc it says my icloud is on....
