It sounds as if there is nothing that can be done about my mother's predicament since there is no proof of ownership. I did suggest some things in my original post that Apple could do, though, since their service is what is locking people out of legitimately purchased devices. She is going to take her Ipad up to the Apple store, though, and hopefully they will help her out once she explains what happened.

The neighbor will need to remove the iPad from her iCloud Account.
This is is the ONLY way to get it to work.

Why would Apple open up a black market for iPhone and iPad thieves? I for one would not like to see Apple do this at all! But it's a free world, so suggest it to Apple here Feedback
They will not respond but if enough people complain about the same issue (good luck there) then they may listen.

The current system assumes everyone has stolen a second hand Ipad if they have been locked out and cannot contact the previous owner. That is a problem. If Apple had a system that lets the original owner log in and flag the device as stolen and also that checks if a device has been reported stolen when someone brings it into the Apple store, then thieves would never bring the device in to be unlocked. I like the security, but it just has this one flaw that should be looked at. You can log in and wipe your data remotely, so why not add something like this to it? They could also require the new person to show ID and record that info into their database in the case the device is reported stolen after someone brings it in to be unlocked. It can be done and would solve the problem.
