JJWActually, you do have to supply your Apple ID and Password when you go to Settings>General>Reset>Erase All Content & Settings. That turns off Find My iPhone on the device - I just checked it. So, you don't have to do anything differently that you would have had to do before. Resetting all Content won't do it. You have to erase the device.

If you 'clear' out iCloud the security system is off.

JJWEven if you don't sign out of iCloud, if you choose to simply Erase all Content and Settings or Restore the device from iTunes, once it is complete the device will present you with the Enter Apple ID and password Activation lock screen. So even then, you would know that you still need to perform additional steps.
Unless of course you restore it, and then never bother to look at the screen again at all to make sure its completed.
There is no point in this entire process where you have to guess what needs to be done. Apple makes it abundantly clear.
And if it was an honest mistake, and you do sell it with Activation lock in place, if are the rightful owner, and the buyer can get a hold of you, there are ways to resolve it easily.
Its all about actually taking the time to do it properly. And not blaming Apple for what other people failed to do.

I just Erased All Content & Settings on my iPhone 5s running iOS 9.1, and when I did that, it made me put my Apple ID and Password in before it would erase the device. That, in turn, turned off Find My iPhone. I got an email immediately after putting in my Apple ID and Password telling me that Find My iPhone had been disabled:
Find My iPhone has been disabled on GB'S 5s.
With Find My iPhone disabled, this device can no longer be located, placed in Lost Mode, or remotely erased using icloud.com/find or the Find My iPhone iOS app.
In addition, your Apple ID and password will no longer be required for someone to erase, reactivate, and use your iPhone.

I checked my iCloud.com account and the device was no longer there.
So, not sure why, if you are performing an Erase All Content & Settings, one would have to do anything further concerning iCloud or Find My iPhone or Activation Lock....

Dec 8, 2015 4:15 PM in response to gail from maineby Phil0124,I just tried it myself, but all it asked me for was my Passcode. I did not go any further, since I did not want to erase everything from my iPhone. But after entering my Passcode it asked me to confirm deletion by pressing the "Delete" button
Would it have asked me for my Apple ID then?
In any case, whether it asks you or not there, the Activation Lock screen will pop up once Restoring is complete more so if the restore was done through iTunes.
If it does request the Apple ID when restoring form the device itself, then its even easier, as there are no extra steps, and its guiding you directly.
But in either case, its clear what needs to happen-. No?

At least now, we all (should) know better. :-/

The only way to get it removed is to take it into a Apple store with your proof of purchase and you ID and they can unlock it for you. This is the only way it can be removed unless the previous owner removes the device from their iCloud.

of purchase. If you are the original purchaser from Apple or Apple authorized iPhone
reseller and have proof of that original purchase showing the serial number of the
iPhone, then Apple may assist you. But not for gray market or 2cd hand or used
iPhones or iPhones from acquired from other than Apple or Apple authorized resellers.
Please provide a link to the policy you claim is in effect whereby Apple will unlock
iPhones from 3rd party sales.

Dec 8, 2015 7:16 PM in response to Phil0124by gail from maine,Yeah - I took it all the way and erased my device (twice). It turned off Find My iPhone, which means that had it then been restored via iTunes, there would have been no Activation Lock to be removed.
So, if a person did an Erase All Content & Settings on their device, then gave that device to someone who then connected it to their iTunes account to restore the phone from their own backup, they would be able to, and would not encounter the Activation Lock....
So, again, and as Csound has indicated, the info is out there and easily accessible, and it very clearly indicates that the device should be erased. Once erased, Find My iPhone/Activation Lock is gone....

Again, if that is what happened, then you did not go to Settings>General>Reset>Erase All Content & Settings. Because, as I have stated, and have just tested (twice), when Erase All Content & Settings, your iCloud account is removed, and Find My iPhone is turned off on the device, so it is no longer Activation Locked:
Find My iPhone has been disabled on GB'S 5s.
