My brother has been locked out of his ipod touch and weve tried everything to get back into it. Is the apple store able to repair this? or are we able to exchange for a new one? If so what would be the cost?

Forgotten Restrictions Passcode Help

You will need to restore your device as New to remove a Restrictions passcode. Go through the normal process to restore your device, but when you see the options to restore as New or from a backup, be sure to choose New.

Also, see iTunes- Restoring iOS software.

Apple does not do trade-ins. An exchange is only for a device that is no longer working - dead, for example. Not like yours which is probably fixable. Exchanges are only done for an exact same refurbished model, not a new one.
