On my Iphone 5s the mute button is not the button to mute, but will lock the phone for rotation.
And its impossible to change even the guy on apple support didn’t know how to change this.
Is there anything to change this ??

That shouldn't even be possible... Plug it into your computer running iTunes and restore it.

no not jailbroken, but the phone is from a back-up from my 3gs
but if I restore it will I lose al my settings, apps contacts?
Not if you've been backing it up and syncing it as intended.
You MAY need to restore it as a new device if there is corruption that is also affecting your backup.
