You'd have to restore the device to factory default and set it up as a new device. OR guess at the passcode till you get it

Forgotten Restrictions Passcode Help
You will need to restore your device as New to remove a Restrictions passcode. Go through the normal process to restore your device, but when you see the options to restore as New or from a backup, be sure to choose New.

I not only couldn't reset my phone because it prompted me to turn off Find my iPhone, and that wouldn't work as it was saying I was going to an unsafe site. I finally just went to the Find my iPhone website, marked my phone as stolen and had it erase itself when it was turned onto the internet. When then resetting it, I DID NOT restore it from back up and made it restore as New Device. Hope this helps, because even Apple Care didn't figure that one out for me.
I was trying to restore my iPhone 5 to the factory settings so I can trade it in when I was asked for a Restrictions Passcode. I just scratched my head because I'm sure I never created such a passcode. After making 3 attempts at the code, and following lots of advice on these boards, I finally came across Kappy's suggestion to use iTunes to restore the phone and circumvent the passcode. It worked like a charm - thank you.
