Why does the up to date program not work in Germany?

Hi everybody,

I'd like to sign up for the up to date program (http://www.apple.com/uk/creativity-apps/mac/up-to-date/) because I bought a new MBP without Keynote, Pages etc.. In the terms of the page it says:

This offer is good only in Austria, France, Germany, Ireland, Italy, Spain, Switzerland and United Kingdom, and valid only in accordance with the terms set forth in this document.

When I sign up with my AppleID I have to choose a state in the USA. The terms that I have to confirm during the process (http://www.apple.com/up-to-date/terms/) includes this information:

This offer is good only in the United States (50 states and the District of Columbia) and Canada, and valid only in accordance with the terms set forth in this document.

So?! Am I allowed to sign up with a MBP that was bought after the 22nd Oct?
