How come the ipod touch 4th generation cant get the ios 7 update yet the ipone 4 can? It doesnt make any sense considering they are the same generation.

Because the iphone 4 has the hardware needed to run ios 7 and the ipod touch 4th gen does not.
All the iOS devices compatible (iPhone 4 and later, iPad 2 and later, and 5G iPod touch) with iOS 7 have at least 512 MB of memory (RAM). The 4G iPod only has 256 MB
It has nothing to do with fairness but with what the hardware is capable of doing as is usually the case with computer and other high tech. It all comes down to the iPhone 4 can and the iPod 4 can't.
