iPod 5th Gen iOS7 Help!

I recently bought an iPod 5th gen with iOS7 and it's asking for an iCloud activation. Unfortunately I don't know the previous owner The iPod was purchased from. Is there a way I can fix it or am I stuck with a $150 brick? It's really frustrating because I didn't steal it or anything yet I'm being screwed out of my money... -_-
