Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.
iOS: Wrong passcode results in red disabled screen
If recovery mode does not work try DFU mode.

For how to restore:
iTunes: Restoring iOS software
To restore from backup see:
iOS: How to back up
If you restore from iCloud backup the apps will be automatically downloaded. If you restore from iTunes backup the apps and music have to be in the iTunes library since synced media like apps and music are not included in the backup of the iOS device that iTunes makes.
You can redownload iTunes purchases by:
Downloading past purchases from the App Store, iBookstore, and iTunes Store

You have to restore and thus erase the iPod. The disabled is a good security feature.
After restore you might be able to recover info from the iPod

There is no way...you must follow the instructions in http://support.apple.com/kb/HT1212 or http://support.apple.com/kb/HT1808 by going through recovery mode with automatically resets to factory condition.
what about the gecko toolkit thing?
theres no loophole? no way around it? ive been trying desperately NOT to restore it and i dont want to. if i find a loophole ill post it, but im not restoring it. even if i have to wait 43 years.
You are free to wait for 42 years. I suspect the battery will be very deat by then and yo still can't access the iPod
