My iPhone 4s kept turning on/off by itself so i sent it in to apple store. they wiped it and told me i MUST not restore from my old backup bcuz it is a software problem and so it would come back.
Would it be safe to sync it with contacts, notes, etc. from my laptop on itunes, but not 'restore' it?
please help me answer this question.. it would save me a lot of time.

It sounds like they are asking you to restore the iPhone as New, which means the data is not coming from a backup file. If you have your contacts, calendars, etc. in an iCloud account, all you have to do is turn that account on.
