Please help
I can't get anything from the App Store as I can not change the previous owners email address in it even though I have up dated my iCloud account on the phone where am I going wrong

Go to Settings and sign out of theirs and into yours.
Click Support at the top of this page, then click Manuals
Hi tried this and it hasn't worked. Still shows their email address in the App Store
Settings > iTunes And App Store > Tap on the ID and sign out and sign back in with yours
Go to Settings>General>Resets>Erase All Content and Settings.
Wipe the phone.
When it starts back up, set it up with your account.
One caveat to KiltedTim's advice, turn off Find My iPhone before wiping the device.
Honestly, this friend should have turned the feature off and wiped the device before giving/selling it to you.
If the OPs information is correct, it's a 3G, which means it can't run iOS 7. Activation lock doesn't apply.
