Retrieve a backup from itunes

Hi, I have an iphone 4S and was recently backed up to my PC (not icloud)... long story short iphone 4S became completely disabled, even apple store could not help. my 4S had "Find my phone" app installed and running. Now with a new Iphone 5S, I go to itunes to restore recent back up to my new iphone 5S and the recent back up is there and visible but it says I must turn "Find my phone" off on My Iphone 4S to restore backup to new phone! The old phone can't so any of this! How do I retrieve my back up and override this Find my phone issue??????????? Please help!!!!
