Neither of my buttons work on my iPod, am i able to download/update to get the onscreen button to get in and out of music/ other apps

You need iOS 5 or later on the iPod, Only the 3G and later iPod can get iOS 5

The Settings>General>Software Update comes with iOS 5 and later.

Connect the iPod to your computer and update via iTunes as far as your iPod model allows
