Q: i brought a iphone of someone on ebay but wont let me activate the phone bcos its saved to his icloud. what do i do and how do i delete his account. it tells me i need to have his password.

What it tells you is correct; you'll need the seller's Apple ID and password. Or you will need to get him/her to go into iCloud and erase the iPhone. Read the section titled "What if I purchase a device that is still linked to the previous owner's account?" in this support article:

There is nothing you can do to make it work. The original owner is the only one who can disable the Activation Lock on the phone. The original owner must do what is described here: http://support.apple.com/kb/HT5661

Hopefully you have their contact information. If not, then you are out of luck. The phone has to be removed from their icloud account. They must sign in to icloud.com and remove the device!

File a complaint with eBay and get them to force the seller to allow a return and give you your money back. You bought an iPhone you can't use and that was quite possibly stolen.

If you bought it on eBay you should have buyer protection. Contact eBay and report it as fraud.

It's very likely that you bought a stolen phone, because anyone selling a phone legitimately would certainly erase it first to protect their personal information. Erasing it disables Activation Lock so the phone can be re-registered by the next user.
