I have bought an iPhone 4 s privately but it had been updated to ios7 software and it won't let me set up phone without using original owners Apple ID and of course I'm unable to contact him since the purchase, is this phone now worthless?

But that is ridiculous as I actually swapped him my iPhone 5 in return of this phone and money and I had also updated my phone and then wiped and reset before I gave it to him so he therefore needs my Apple ID to restart also...... This new security feature was not made clear to anyone who did the update
Then he has the same problem as you. Which means he will probably try to contact you, unless he stole the phone he sold you, which is why the new security system is set up the way it is.
Yes I understand the new security system and the need for it which is obvious but if people are not aware of this new system for security then there will end up being a lot of un used worthless phones out there
And mine isn't stolen as I'm sure the employees I have spoken to at apple would of told me this when I entered the phones imei number, true?
No. That's not necessarily true. Apple does not keep a database of stolen devices.
Contact whoever you got the phone from. That's your only hope.
