Lost my iphone. Will the thief be able to access to my data?

My iPhone 4s (ios7) was locked when it was stolen, and the thief turned the phone off right after he stole it. I immediately activated Lost mode through Find My iPhone, but it seems like he took the sim card out. I believe that Find My iPhone is pretty much useless once the sim card is removed before the lost mode of Find my iPhone gets activated. My question is that when one takes a sim card out from an iphone, does that automatically unlocks the phone? Or would they be able to unlcok the phone without losing the data (assuming that he doesn't know my passcode)? My phone probably is already sold by now, but I'm just wondering if he/she would be able to access to my photos, notes, and etc.

thanks in advance!

First of all, the SIM card has nothing to do with Find My iPhone. Find My iPhone will activate once the iPhone uses WiFi.

Secondly, since you have iOS 7, Activation Lock is also in effect. It is described here:

So if a thief tries to sell your iPhone, the new buyer could not use it.

with the new activation lock securtiy feature on IOS 7. That phone is completely useless to the thiefs or whomever they sell it to.

If they restore yoru phone, they would need to know your apple id and password and need to disable find my phone, which they can't because they don't know your password.

As a precautions change all your password.

Report the thief to your local authority and phone carrier.

Did the iPhone have a passcode on it? From your description it appears that it did. Did you have iOS7 on it along with having Find My iPhone activated? It appears from your profile you had iOS 7 and you talk about using Find My iPhone.

Removal of the SIM card does not unlock the device, it just makes it where it can no longer connect to the cellular network. With iOS 7 and Activation Lock, and with your passcode lock, the thief will not even be able to successfully restore the device, let alone activate it. Even if he was to restore it, it still will not activate without your Apple ID and password. Attempts to activate will require connection to the Internet which will connect it to Find My iPhone which will institute your Lost command and show it on the map. The device is useless to the thief, but they still may try to sell it. They do that and the Activation lock will do the same thing for the unsuspecting buyer.

I do have iOS7 and I may have confused myself with what it means to get an activation lock. I clicked the lost mode when the phone got stolen (and also when it was off). It still says "Pending: Lost Mode" in Find My iPhone of icloud so I guess it is not 'activated'. Would they be able to wipe out the iphone without wifi?

No. As indicated by all of the responses you received, Activation Lock is part of iOS 7 and Find My iPhone. It does not require any further input from you. All you had to do was download and install iOS 7 and activate Find My iPhone. You did all of that. You did not have to "get and activation lock" or anything else. As described earlier, the device is useless to the thief and anyone else he tries to sell it to.

Thanks a lot for detailed descriptions! I just have one more question. I installed Find My iPhone before I updated to iOS7 and ever since I updated to iOS7 I never logged into Find My iPhone--does that mean it's still activated? Although it says offline, the device still shows on icloud. And I may have turned the gps off on iPhone trying to save battery before it got stolen. Would that turn off the gps for Find My iPhone as well? Thank you very much!! I appreciate all your help!!

Can they in anyway activate phone. Mine stolen last Friday and I use find my iphone. Have not seen phone on line. Do have fingerprint and password. Did not erase iphone as apparently this turs off find my iphone app. The phone is listed as actions pending with sounds and lost mode to be shown when phone goes on line. So if they did not go online could they have somehow reset or wiped phone.

To make things moe confusing, the tabs open on iphone were shown in icloud thus week on my iPad, but not today

My meid # is listed in national data base in canada as representing stolen phone

Any help appreciated

Thanks

If it is still displaying pending, then the device has not been connected to the Internet. Activation lock is part of iOS 7, so if you had the on the phone and Find My iPhone activated, which you report that you did, then Activation Lock is active. You can check out this support document for more information about Activation Lock if you like. http://support.apple.com/kb/HT5818

If the device is showing off line, then it is very possible it is still powered off. It needs to connect to the Internet for Find My iPhone to work.
