iPod Nano firmware update and volume cap

Hi,

I have a 7th gen iPod Nano bought in the USA and hence with no volume cap as opossed to EU models. I'm still running firmware 1.0.2 and I'd like to upgrade to 1.0.3, but I'm scared that doing so will introduce the EU volume cap, since now I'm in Italy. Should I avoid the firmware upgrade ?
