I have carried all the checks on the support pages but still the mouse is intermittent nad has new batteries, any ideas on the fix?

Delete your device's Bluetooth profile and turn it off. Restart your computer and then pair your Macbook with your magic mouse.
I hope this helps.
My magic trackpad did the exact same thing and that was the solution.
