y son received an iPod 5th gen for Christmas but it hasn't been updated so it is using the 6.1.3 version. My MacBook and the iPod itself won't update, any ideas on how to fix this please?

What exactly happens when you go to Settings>General>Software Update?
It says:
iOS 7.0.4
Has an empty updating status bar
Estimating time remaining (which hasn't changed at all during any attempts of updating)
Then there is a summary of what the update is.
Nothing has happened since updating, it almost appears frozen (which it's not). When I try updating with my MacBook it says:
"Contacting the iPod software update server"
That is as far as I have gotten trying the update on MacBook as nothing happens afterwards.
Update Server
Try:
- Powering off and then back on your router.
- iTunes for Windows: iTunes cannot contact the iPhone, iPad, or iPod software update server
- Change the DNS to either Google's or Open DNS servers
Public DNS — Google Developers
- For one user uninstalling/reinstalling iTunes resolved the problem
- Try on another computer/network
- Wait if it is an Apple problem
