will a brand new 1st gen iPad activate iOS 6, mine was stolen...

I want to get a new iPad mini 64GB AT&T model #MD536LL/A

My question is if it is brand new older generation iPad mini, assuming it has iOS 6.1.3 installed by default since this model is no longer made....

will it activate in ios 6.1.3 or will it be required to immediately update to iOS 7???

thanks....

If it has iOS 6.x.x pre-installed, it will indeed activate even if it's running iOS 6.x.x

The update will be offered to you after it has been activated. You can choose to decline if you wish to stay at iOS 6.x.x

Just beware that you may get an iOS 7 update auto-pushed to your device if you choose to remain on iOS 6.x.x. This update can rob your device of ~3.1 GB of storage space until you update (you, yourself need to push the "update" button) to iOS 7. If you don't update, the update package will remain on your device using the stated storage space.

Does anyone know if ANY of the 1st gen 64gb would come with iOS7?

it seems that they would come with the last version of ios6 since they are no longer made (except the 16gb) version?

I want to get one WITHOUT ios7 and it would seem that all the 1st gen 64GBs were discontinued once the new models came out so those older 1st gen models should have iOS6 as the defualt on those.

Can anyone confirm that?

Likely no one would be able to absolutely confirm it. But I would assume that they would still have iOS 6 preinstalled on them. Apple would have to have stock returned to them to have the new iOS pre-installed. The iOS is easily updated via internet. I would think Apple would just let these devices be updated by the user rather than go through the hassle of getting them back and then pre-installing iOS 7.

Both myself and Kappy have already confirmed this to you. Once again, you do NOT need iOS 7 to activate the device. It will activate under iOS 6 if it's already installed on the device. I still have two iPads still on iOS 6 and have restored them as new (from the device but NOT under iTunes which will automatically install iOS 7) and have no issue activating them.

You cannot *download & reinstall/restore* iOS 6 or below on any device that qualifies for iOS 7. iOS 7 will be installed on it.

If the device ALREADY HAS iOS 6 installed on it and you reset the device ON THE DEVICE ITSELF under Settings>General>Reset>Erase All Content and Settings, the iOS version will NOT be updated. It does NOT check for signing when resetting in this way. It will remain at the version currently on the device. If you are on iOS 6.0, that's where it will remain. If you are on iOS 5.1.1, that is where it will remain.

If you restore the device using iTunes, the device WILL be updated to iOS 7 or the highest iOS version that the device is capable of running. This is where the signing of the iOS is checked and this is where it WILL be updated if you are not on iOS 7 or what is current for the device.

Activation does NOT check for iOS signing since ALL devices, regardless of their iOS version need to be activated...iPad 1st Gen, 2nd Gen, iPhone 4. It make NO difference. Activation has nothing to do with the iOS being updated or not updated.
