If the seller cannot or will not do so, then the seller needs to refund his money.

Then he needs to talk to whoever he purchased it from. If they can't or won't remove the lock, odds are it's stolen. Apple won't get involved.

He doesn't. The current seller would follow the same steps as the current purchaser. He or she would contact the person they bought the device from for assistance. If the original owner of the device, or the account holder of the Apple ID used to enable Activation Lock will not help, then this iPhone is now a shiny paperweight.

Feb 26, 2014 12:31 PM in response to Lord_Odby KiltedTim,No authorized reseller would allow this to happen. They wouldn't be stupid enough to sell a phone that was activation locked. There is no such thing as an "authorized refurbisher" for iPhones.
Apple will not intervene. The ONLY way you can get Apple to act on it is if you can present them with an original proof of purchase for the phone from Apple or an authorized distributor.
