how to erase original apple i.d if the previous owner is not able to be contacted??

bought iphone5, was unaware it was disabled,

ive reset it, but cannot activate it due to an apple id that its been registered to..

is there anyway thsat i can activate it an register it to my apple id, as im unable to get in contact with the previous owner..????
