How can I get my 44 audio books back following upgrade to iphone5s
I upgraded to 5s today and all my audio books are gone. How can I get them back?

Audiobooks are one-time only downloads from the store so you will need to sync them back from the copies that you have on your computer's iTunes or your backup of your downloads. If you don't have them on your computer or on your backup of your downloads then if you still have your old phone with them on then you can copy them from that to your computer's iTunes via File > Devices > Transfer Purchases so that you can then sync them.
If you haven't got a copy of them anywhere then if they are still in your country's store then you can try contacting iTunes Support and see if they will grant you a re-download : http://www.apple.com/support/itunes/contact/
