How can I recover test messages from my Iphone 3 and I have now an Iphone4S? I need them to be use in court asap. Thanks

Can you not just turn on the iPhone 3 and look at them?
Have they been deleted?
Was the 4S setup with a restored backup that was made of the 3?

The iphone3 use a different sim size and when i upgraded to the 4s they left the old sim inside the phone and sustituted for the new sim which is smaller. When I turned on thee iphone 3 it is not active and is giving me a message as " Your Iphone could not be activated because the activation server is temporarily unavailable"
I didn't deleted any of the text before the upgrade nearly a year and a half ago.
I don't remmeber them restoring backup by that time

To get messages off the phone, you would need to use 3rd party software to extract them and print them. Touchcopy is a good choice. Depending on how much you need to do, the free version might work. The 3rd party software is loaded on your computer and then the phone is connected to the computer and information is extracted.
If the phone is now prompting you to activate it, anything that was on it is long gone. I think you're out of luck.
On the bright side, maybe you could file a FOIA request and get copies of them from the NSA...😉
