I think my iPhone 5 got stolen and it's not backed up and it's dead any suggestion on how to get the data or location of it. Find my iPhone is Installed but not turned on and the phone is off and dead when stolen and I just would either like to get all the data off especially pics and contacts

Sorry, but without "Find my iPhone" activated you can't do anything. If you had iOS 7 installed, the Activation Lock could have made your phone useless for the ones that stole it, but that does not work on iOS 6.
You can try to contact your carrier and report it stolen, if blocking the IMEI is supported by the carrier.
I actually do have IOS 7 sorry didn't know that make a difference
