I have an old iPhone that has the 4.2.8 version and I cannot update my phone to the newest update because it says i have the newest itunes and i dont know what to do other than buy a new phone can somebody please help!!!!!!!!!!!!!!!!!

Alright, your profile says you have an iPhone 4, is that correct? What computer OS are you using. This could be what is preventing you from downloading the latest iTunes. The latest iTunes is 11.1.3.

You need OS x 10.6.8 as a minimum for iTunes Version 11
If possible you need to Upgrade your Mac.
Upgrading to Snow Leopard = OS X 10.6.x
It is Not available as a download... It is a Paid Upgrade.
Do this first...
Check that your Mac meets the System Requirements for Snow Leopard...

If so... Purchase a Snow Leopard Install Disc...

After the Successful Install, run Software Update to get the latest updates for Snow Leopard and iTunes.
You will now be able to Sync your iPhone
Be sure to make a Backup of your Current System Before Upgrading...
That is why I was trying to get the answer earlier. See the specs for the latest version of iTunes.

No problem. At least you know what you need now. That version of OS X is required for iTunes 11.1, that version of iTunes is required for iOS 7.

Yes... as you have iOS 4 installed.. and iOS 5 or later is required to Update OTA = Over the Air.
