So despite my best practices I have lost some media off disks due to a HD failure. Why can't I recover thise files I purchased from the Apple Store? With itunes?

You can.

iTunes prefs > Store.

Show iTunes in the Cloud purchases.

This will show all purcahses in your iTunes.

Click the cloud icon with a down arrow to download them.

Use the backup of the computer to put everything back.

You do regularly backup your media and other important files, correct?
