You will never be able to activate and use that phone yourself without the original owners iCloud password to disable activation lock. There is no way around that.
If you cannot get in touch with the original owner, or the seller cannot help you with it, then you have purchased a useless piece of plastic and metal. Can you return it to the seller for a refund?

The Apple ID and Password that was Originally used to Activate the iDevice is required.
If you cannot get this information from the seller
Removing a device from a previous owner’s account
You need to return the Device for a refund, as you will not be able to re-activate it.

Jan 22, 2014 5:36 AM in response to rodcat2by Axeman1020,It should also be mentioned that if you are truely running OS X 10.4 then you will not be able to sync an iPhone running iOS 7 with iTunes. iOS 7 requires iTunes 11 which requires OS X 10.6.8 or later.
