With iOS 7 they must have your Apple ID and password to erase the device and use it. If they can figure out the passcode then they can access it and get access to unprotected information. However, if you configured Find My Phone once the device goes online you can have it instantly locked or erased. Sign into icloud.com to set that up if Find My Phone is turned on in the phone. What To Do If Your iDevice or Computer Is Lost Or Stolen

iPhone, iPod Touch, and iPad

If you activated Find My Phone before it was lost or stolen, you can track it only if Wi-Fi is enabled on the device. What you cannot do is track your device using a serial number or other identifying number. You cannot expect Apple or anyone else to find your device for you. You cannot recover your loss unless you insure your device for such loss. It is not covered by your warranty.

If your iPhone, iPod, iPod Touch, or iPad is lost or stolen what do you do? There are things you should have done in advance - before you lost it or it was stolen - and some things to do after the fact. Here are some suggestions:

I think you are trolling.

If Activation Lock has been initiated, there is no way for the iPad to be used

unless the person attempting to use the iPad knows the passcode. If the iPad

had previously been jailbroken, there may be a problem. On a stock, not

hacked, installation of iOS 7 or 8, there is no workaround for Activation Lock.

It all depends,

Did you have a password on it? If so, no they cannot. What you want to do and I STRONGLY RECOMMEND is going to www.iCloud.com, put in your Apple ID information to sign in, and you "find my iPhone" to set the the device as "lost". When you set the device to "lost" you may set another security code, and a message, in which you can tell the thief who, and where to return the device to. You can also see the location of where the device is. If you wish, you may also completely erase the idevice. This all happens and is implemented the next time the device connects to the internet via mobile wifi or wifi hotspot.
