If it's your iPod and you know your Apple ID and password, then go see iCloud- Find My iPhone Activation Lock in iOS 7.
The website to turn off find my ipod is icloud.com/#find. Turn off your ipod and then log into the website, and click devices. Click on your ipod and remove from account.
Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.
