how do i get pass an activation lock?

I recently bought a iPod touch 5th gen on eBay and it is what they call activation locked. Hi do I get passed it so I can use it?

Either get and enter the Apple ID and password or have the person remove it from their account

otherwise return it or you have an expensive, thin brick
