My son wants to sell his iphone 4 buy a 5s. The 4 has flappy birds installed on it and he wants to sell it advertised as still having this app on it.
How can he erase all his personal data but leave this one app on the handset?

The app is his. He cannot give it away.
No. Even if one could, that's not legal.
But you can share apps via itunes when you back it up to your compter so how is it not legal?
The license allows sharing content between family members on devices that are registered to the same Apple ID account. If he left an app on the phone he is selling the buyer would need to know your Apple ID and password every time the app needed updating. And any in-app purchases would be charged to your credit card.
Followup: I now see why he wants to leave it. Flappy Birds has been withdrawn from the market by its creator. Phones that have it installed are selling at premium prices. but it's still illegal to distribute an app that you own to anyone other than family members who share your Apple ID account.
So, I can't erase everything and yet leave this app? Is that impossible.

so when people are selling these with this app on it, they are truly selling rights to their apple account with someone ... and this is why it is going for so much on ebay, hackers?
Actually, when they remove the "account" from their Apple ID, they would cause the phone to be unusable. Anyone who purchases a phone for the purposes of having that App on their phone is taking a BIG chance.
eBay doesn't allow it. They require that devices be wiped before being offered for sale. They've been pulling any iPhones posted as having Flappy Birds still on them.
