Only the owner can do that. If the owner is not doing it, maybe the iPhone was stolen.
This is the new IOS 7 Activation Lock to prevent thief from using it and it cannot be bypass.

We can't and neither can Apple. You will need to get hold of the previous owner and have them remove the device from their account. There is no workaround.
