My daughter is trying to download the find my phone app and it is telling her she need IOS 7 to do this. According to the information here, she shouldn't need it. It is an ipod touch 4th generation. Any suggestions?

Why does she want it?
It does nothing to help you find the ipod on which it is installed. It is only for finding other idevices from the ipod.
Her ipod was stolen and we recovered it, but we were told that if she had that app on her ipod we could have tracked it...

This is not what the app does at all.
The find my ipod feature is built into the ios. You need no app at all to be abel to locate it on icloud. Just turn on the feature on the ipod.
