Sorry, I know this cost you a lot, but you really need to at least report the possibility to the police to avoid potential serious legal consequences. I'd also suggest you contact Amazon and see if there's anything they can do to help in this matter since their affiliate sold an unusuable product.

Jailbreaking voids the Apple warranty and also means that you will not get any support from Apple, including from this Apple forum. Jailbreaking can't be discussed in this Apple forum.

No, it will not work, not unless you have the original owner's Apple ID and password. Without that, or the cooperation of the original owner in removing the iPod from his/her iCloud account, you cannot use that iPod.

1. Know your seller.
2. Not all people can be trusted.
3. Let the buyer beware.
