I have purchased an apple ipad from a company that has previously been sold and returned but has been linked to the icloud. I cannot get in contact with that person and do not know thier identity. Can the link be removed via apple.com using the serial number and proof of purchase.

No. There are only two ways to disable activation lock, and both require the previous owners iCloud login and password. If you know those, you can disable it on the device itself, or the previous owner can log in to their iCloud account in a web browser, remote wipe the device and remove it from their list of devices in iCloud.
But, without the previous owners active help or participation, you cannot disable Activation Lock. There is no other way.
