You must contact the original owner. That is the only way to release Activation Lock.
If you cannot do that, get your money back. If you cannot contact the original owner, you very likely purchased a previously stolen iPhone.
theres no way for me to contact the original owner. hte iphone cant be stolen because the store i got it from makes sure their devices arent stolen. there has to be some advanced way to get around this.
There is absolutely no way around it.
Get your money back from the store. Or exchange the iPhone there and make sure the one you get in exchange does not have this issue.
i cant return it. what would happen if i brought it to the Genius Bar at my local Apple store?
We cannot speak for Apple here.
But I will tell you that Activation Lock cannot be circumvented. Apple will not do that, nor will anyone else.
They'll do noting, since it's second hand.
Again this is the new security feature and cannot be bypassed.

They would ask you to remove the Activatio lock using the AppleID/password.
ive brought second-hands to them before. ive gotten help.
if i brought it to them and explained my situation?
Yes, Activation Lock is an anti-theft feature that Apple enacted last September. Items purchased before that were not subject to Activation Lock.

Not with Activation Lock.
But sure you can try.

but they don't make sure the phones they purchase have the activation lock removed and can be used again?
Sounds like a poor excuse of a store...
i know what activation lock is

Great. Then you might as well accept the fact that your iPhone is activation locked, and will remain useless to you.
no need to be snobby about it. ive already come to terms that this iphone is umseless to me. i was siply searching for help.
