What am I supposed to do if I can not contact the person that i got my ipod touch 5 gen from, to get there apple id and activate the ipod

There is nothing you can do. You have a Device you cannot use.

Apple will not help unless possibly if you initally purchased the iPod from Apple. Since that is not the case, Apple will not help.
