The phone can only be unlocked by the carrier, if this is supported by the carrier.
To use a phone without a carrier plan, you'll have to buy an officially unlocked phone from Apple, not every carrier sells unlocked phones, most of them come with a contract and are locked to the carrier for a certain time.
