I have an iPhone3 that i use as my 'spare' phone or iPod... the battery has just expanded in my hand...i have photos on there, some which are new, how do i get them back?

Unlikely that you can.
Take the device to Apple for evaluation. They may be able to simply replace the battery but more likely the entire device is a loss.
Have you failed to regularly copy pictures taken with the device off to a computer as would be done with any digital camera?

i think i might have to go into apple hopefully they can do something about it... i also enjoyed using it as an ipod too.
i have most of the pictures off it but the last time i used it i took a few more pics and havent backed up since.
Apple cannot retrieve data off an iPhone for a user. If that is the expectation when you walk into the store, you will be disappointed.
oh okay... so then if they can replace the battery the phone will be reset?

I honestly do not know, ask them if replacing the battery requires a reset.
