There is nothing you can do. You need the former owner to do the following:

Removing Previous Owner from Device

The device is locked with the Activation Lock:

ACTIVATION LOCK

There is no way around this. If you cannot get the previous owner to follow all of the steps in the first link, then return the device for a refund. You will not be able to use it.
