3rd Gen iPod Touch iCloud account

A 3rd Gen iPod Touch I purchased has an iCloud account on it.

But Find my iPod is turned off.

Am I ok to restore the iPod or will it become iCloud locked?

I read as long as Find my iPod/Phone is turned off then I am ok to restore but I want to be sure before risking turning a $100 iPod into a brick.

This iPod was purchased as a lot and not from the very original owner. Getting the password is not possible.
