so wheni try to to get in to my account it saysthis e-mail can not be use to unlock this phone

Before you can use the phone, you are going to have to have the previous owner sign off of iCloud and turn off Find My iPhone:
Removing Previous Owner from Device
Unless you can have the steps above completed, you will not be able to use the device.

Apr 15, 2014 12:39 PM in response to richie18882by Lawrence Finch,You have to turn off Find my iPhone on the phone. To do this go to Settings/icloud and turn it off. You will need the password for the Apple ID account that the phone was connected to.
You can also log in to https://iCloud.com/find and remove the phone from your account there. In either case you will need to know the Apple ID and password that the phone was activated with.

What do you mean it "won't let you sign into your email". Did you change your Apple ID? When it "won't let you sign into your email" what error are you getting that is preventing you from doing so?
You need to provide us with complete information. We cannot see your device, nor do we have any clue what you may or may not have done up to this point. If you don't take the time to provide us with a complete, clear picture, then we cannot help you....
