Please tell us what makes you think that it might be hacked or infected with virus?

You can save your videos and photos by importing them to your computer. Ring tones purchased through the iTunes store would be re-downloadable. Texts and messages would only be able to be restored via a backup, so you would have to forego those.
And I agree with Allan - not likely that it has been hacked. What makes you think it has?

No, you cannnot re-download ringtones for free. One has to transfer ringtones purchases to iTunes.

I'm not sure what they were doing but they were downloading itunes (a grey box saying itunes) at the same time. I'm scared of confrontations so said nothing at the time but didn't like it. Since then this friend seems to know private conversations I have and photos I take in my photostream. I also removed them from my facebook as a test and they still know what I post there (nothing that interesting but its still upsetting to feel my privacy is being taken). Hope you guys can help. Thanks a lot

One needs to use transfer purchases from iPhone to iTunes.
Audiobooks, ringtones, and tones
If you made a backup of these items on your Mac or PC, you can sync the items to your iOS device. You can't download these items again from iTunes in the Cloud.

A jailbroken device has software installed on it that allows the user to circumvent security features built into the iOS in order to modify how it works. It is not related to whether or not your device is locked to a carrier.
Jailbreaking will, however, make your device vulnerable many issues including removing the built-in protection that the iOS has which protects your device from viruses and hacking:
