Can't bypass restriction function to turn off. Requires passcode we don't have.

We purchased a 3rd gen ipod touch from someone over Christmas holidays for our 11 year old son. He has somehow managed to erase the ipod entirely (along with the 100's of games she left on the ipod for us) as well as disable it so that a restriction passcode has to be entered to access any type of download for the phone. I have reset, restarted and every other troubleshoot I know of and still cannot find the app store or load games via my computer through itunes because of the restriction passcode. Can't turn off the restriction because he disabled the device too many times. (I'm ready to strangle him and throw the device against the wall at this point...any help to avoid this will be greatly appreciated.)

iPod touch, 3rd Generation

Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.

iOS: Wrong passcode results in red disabled screen

If recovery mode does not work try DFU mode.

How to put iPod touch / iPhone into DFU mode « Karthik's scribblings

For how to restore:

iTunes: Restoring iOS software

To restore from backup see:

iOS: Back up and restore your iOS device with iCloud or iTunes

If you restore from iCloud backup the apps will be automatically downloaded. If you restore from iTunes backup the apps and music have to be in the iTunes library since synced media like apps and music are not included in the backup of the iOS device that iTunes makes.

You can redownload most iTunes purchases by:

Downloading past purchases from the App Store, iBookstore, and iTunes Store

If problem what happens or does not happen and when in the instructions? When you successfully get the iPod in recovery mode and connect to computer iTunes should say it found an iPod in recovery mode.
