iPhone activation locked but Find my iPhone is disabled.

iPhone is in lost/erased mode but Find my iPhone is disabled. Apparently that's the best the brother of the owner could do. The owner of the iPhone says he doesn't want to remove the iPhone from his iCloud account for whatever reasons, however he did tell me that he disable Find my iPhone. Is there a way to continue through the activation without their iCloud account on my device?
